NO. 418/MPP/Kep/6/2003
ON
IMPORT OF NITRO CELLULOSE (NC)

THE MINISTER OF INDUSTRY AND TRADE,

Attachment

Considering:

• a. that, with regard to the development of security condition in the country, which has not been conducible, to achieve effectiveness in the enforcement of Decree of the said minister No. 418/MPP/Kep/6/2003 on Import of Nitro Cellulose (NC), it is necessary to improve the function of supervision by involving the Indonesian Police;
• b. that, for the foregoing purpose, it is necessary to make an amendment to Decree of the said minister No. 418/ MPP/Kep/6/2003.

In view of:

• 1. Decree of the said minister No. 418/MPP/Kep/5/Z003 on Import of Nitro Cellulose (NC)
• 2. Decree of the said minister No. 479/MPP/Kep/7/Z003 on Guidelines for Surveyor as Performer of Verification or Technical Inspection Into Import of Nitro Cellulose (NC).

DECIDES:

To stipulate:

DECREE OF THE SAID MINISTER ON AMENDMENT OF DECREE OF MINISTER OF TRADE AND INDUSTRY NO. 418/MPP/Kep/6/2003 ON IMPORT OF NITRO CELLULOSE (NC).

Article 1

Some provisions in Decree of the said minister No. 418/MPP/Kep/6/2003 on Import of NC are amended as follows:

1. Amending the provision of Article 3 paragraph (1) clause f so that it entirely reads as follows:

"Article 3

(1) To be acknowledged as IP-NC, the company must submit an application to the Director General of Overseas Trading together with the following documents:

• a. Photocopy of industrial business permit/industrial registration certificate or that similar to the foregoing, from the technical institution supervising the business;
• b. Photocopy of Importer-Producer's Identity Number (API-P) or Limited Importer's Identity Number (API-T);
• c. Photocopy of Company Registration Certificate (TDP);
• d. Photocopy of Taxpayer's Code Number (NPWP);
• e. Productions plan;
• f. Recommendation from the Director General of IKAHH, which is issued based on result of coordination with Head of the Intelligence and Security Bureau of the Indonesian Police.

(2) Approval or rejection of the application as set forth in paragraph (1), shall be issued within (10) working days from receipt of the application."

2. Amending the provision of Article 6 paragraph (2) so that it entirely reads as follows:

"Article 6

(1) Every import conducted by IT-NC must obtain approval for import containing quantity, type, time or import, and port of destination.

(2) The approval for import of IT-NC, as set forth paragraph (1) is stipulated by the Director- General for Overseas Trading based on recommendation from Head of the Intelligence and Security Bureau of the Indonesian Police."

3. Amending Appendix I and Appendix II, as set forth in Article 7 paragraphs (2) and (3) to become Appendix I and Appendix II of this Decree.

4. Amending the provision of Article 11 so that it entirely reads as follows:

"Article 11

(1) Whether the import of NC is conducted or not, the company as IP-NC and IT-NC must submit report in writing to the Director General for Overseas Trading with copies furnished to the Director General of IKAHH, Director General of PDN, Director General of Defence Facility of the Department of Defence, and Head of the Intelligence and Security Bureau of the Indonesian Police, once in every three (3) months since date of issuance of Acknowledgment as IP-NC or Appointment of IT-NC.

(2) The report, as set forth in paragraph (1), is in the form of:

• a. Realization of import by IP-NC, which includes realization of import, quantity, and utilization, as specified in Appendix III of this Decree;
• b. Realization of import by IT-NC, which includes quantity, distribution, and name of latest user company, as specified in Appendix IV of this Decree."

Article 2

This Decree comes into full force and effect from the date of stipulation.

For public cognizance, this decree shall be published by placing it in State Gazette of the Republic of Indonesia.
